BOOKING CONDITIONS

 

BOOKING FORMS: A booking form, signed by the person making the booking, must be returned to us with every booking.

 

BOOKINGS: are made from 3.00 p.m. on the day of arrival until 10.00 a.m. on the day of departure, unless otherwise stated on your key instructions or in writing by us.

 

PAYMENT: 20% with signed booking form, and the balance six weeks before commencement of holiday unless the booking is made within six weeks when the full amount is due. If payment is not received by the due date we have the right to cancel the holiday and re-let it if possible. The payment of any monies to us constitutes a legally binding contract and an acceptance of the Booking Conditions.

BOOKING FEE: This is now a compulsory part of the holiday contract. The booking fee is £15.00 collectable with the deposit and is non refundable.

CANCELLATIONS: When you book a holiday you are entering a legally binding contract. If you have to cancel your holiday you still remain liable to us as Holiday Letting Agents for the final payment on the due date. We strongly recommend that you take out insurance against cancellation of your holiday, and we have arranged a special insurance scheme with P H Hayman & Co. Ltd., Stansted House, Rowlands Castle, Hants, PO9 6DX, Telephone 0845 230 0631. Full details will be sent to you on receipt of your deposit.

Cancellations must be made in writing to us, but the Applicant still remains liable for payment of the full amount of the letting fee. Failure to make such payment will be treated as a Breach of Contract. This does not affect your statutory rights.

Holiday Cornwall Ltd. will always endeavour to re-let the property after cancellation, and if successful, will refund the balance, less £30 +VAT per week administration costs and less any shortfall figure if the holiday was re-let at a reduced rate.You are, of course, at liberty to arrange cancellation insurance through your own source, if you wish.

CHANGING A BOOKING: Once a booking has been accepted by the Company, the booking can only be changed to another property by treating the original booking as a cancellation.

DAMAGE & SECURITY DEPOSITS: Although the property is checked by housekeeping staff if any damage is found which has not been reported to the office, a charge will be made for repair or replacement of same, either by invoice or security deposit.

 

SPECIAL NEEDS & DISABILITIES: We always try to ensure that our customers enjoy their accommodation. Should any member of your party have special needs or a disability of any sort please do not hesitate to discuss their requirements with our staff. They will be happy to advise on the properties best suited for your needs. However, not all properties are able to accept assistance animals (due to allergies).

 

YOUR RESPONSIBILITY: Holiday tenants are responsible for normal everyday cleaning and for keeping the property in an orderly fashion. They are requested to leave the property in a clean and tidy condition on vacation of the property. Liability for damage done to the property or equipment or for excessive extra cleaning necessary on vacation is the responsibility of the person who signs the booking form.

Charges for these liabilities will be forwarded to them. This includes loss of keys, breakages, etc.

 

SECURITY DEPOSITS: Where chargeable, security deposits will be refunded within the two week period following the end of your holiday. Deductions will have been made by us for any damage done or extra cleaning required and liability is not limited

to the amount of the Security Deposit.

 

PARTY BOOKINGS: We are essentially a family holiday booking agency and we actively discourage parties of young people and groups of people.We reserve the right to terminate any bookings, without refund, which are found to be of young people not supervised by parents/adults, even though the booking may have been made by a parent/adult. We also reserve the right to charge for extra cleaning, breakages and damage done to the properties.

TOTAL NUMBER OF PEOPLE: In line with English Tourist Board regulations, the total number of people in your party should not exceed the advertised number and we reserve the right to immediately terminate a booking if more than the stated

number of people are found to be staying.

 

NUISANCE TO OTHERS: We reserve the right to immediately terminate the bookings of parties causing excessive noise or nuisance to others.

LOST PROPERTY: If any belongings are left behind and a request is made to send them on then we will advise the cost of returning the items and upon receipt of same, the lost property will then be returned PETS: Regrettably, pets are no longer allowed at most of our properties in particular at Maenporth and Helford Passage Cove.

MAINTENANCE: We or our representatives reserve the right to enter the property to maintain either the property itself or any equipment therein, at any reasonable time but without notice, whether or not the property is occupied.

 

LINEN: Linen is supplied within the cost of your let, on a weekly basis, on the understanding that any damage done to it will be paid for by you. Beds will be made up on your arrival but not during tenancies. No bedding is supplied for day or Z-beds, or cots.

 

TOWELS: Towels are NOT NORMALLY PROVIDED. However, both Helford Passage and Maenporth are now operating a hire service, only for those holiday makers staying at the properties. A towel bale costs £8 and consists of two hand towels and two bath sheets. For towel hire please contact the Helford Office on 01326 250278.

 

WASHING: You are requested not to dry any washing outside the accommodation on the Maenporth Estate.

COTS, HIGHCHAIRS AND Z-BEDS: These can usually be hired from us, on the understanding that any damage done to them will be paid for by you. Bedding is not provided for cots or Z-beds. If cots or Z-beds are required as extras in any property, this will limit the space therein. These items will be left in the best space possible.

HOLIDAY CORNWALL LTD, the booking agents, have made every effort to represent the properties, tariff and details within this brochure/website, in a true and proper way. As far as we are aware all the details were correct at the time of going to press and we will not be held responsible for alterations made to the complex, the properties or equipment. We strongly recommend that if you are in doubt about something, that you seek a written reply from us. In the exceptional circumstance of any booked property becoming unavailable for letting, we will endeavour to re-locate the holiday-maker into a property of at least similar standard if at all possible.

 

USE OF AMENITIES: The use of all amenities, where offered, such as swimming pools, cots etc. is entirely at the user’s risk, and Holiday Cornwall Ltd./property owners will not accept responsibility for loss or damage to the customer’s belongings, personal injury or loss of life. Any breakdown of amenities or equipment in properties cannot be held to be the responsibility of Holiday Cornwall Ltd., and although every effort will be made to rectify any faults, a guarantee cannot be given that repairs will be effected during the duration of a holiday. Leisure facilities are not interchangeable. Only guests staying at Maenporth may use the Maenporth leisure facilities. Only guests staying at Helford Passage may use the outdoor heated pool at Helford Passage. These facilities may only be used by persons actually residing in our properties and not by visiting guests or friends. Although the Leisure Complex at Maenporth is open all the year round, the opening/closing hours vary according to the season. Opening times of the Maenporth leisure facilities may be subject to change at the Maenporth Management's discretion without prior warning. With regard to the leisure facilities, individual advice cannot be given on how much exercise one should take. All users must bear in mind their personal limitations.

Children under fifteen years of age using the swimming pool at Helford Passage or the leisure facilities at Maenporth must be accompanied by an adult.

 

LIABILITY: The Agents will not be liable for any act, neglect or default on the part of the Owner or any other person, nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property which the customer or any member of his or her party may suffer arising out of or in connection with the holiday or resulting from any other cause whatsoever.
